Is online casino illegal
New casino sites to play real money
In the next section, we'll find out how players make their money available for online gambling. In the 2001 case of the united states v. Jay cohen, the U.S. Prosecuted an american who set up an online sports betting operation in antigua. Cohen took great care to consult with lawyers and accountants ahead of time to make sure that his operation was legal. However, he was prosecuted and successfully convicted on a technicality of the wire wager act. This case is interesting because of the dissenting opinion of justice james oliver, who pointed out the inadequacies of current laws that deal with the internet, the futility of trying to ban online gambling, and the mercurial tides of public and political opinion regarding gambling in general [ref].
How online gambling works
The legality of online gambling
Gambling online falls into a legal grey area. While it is technically illegal in most of the united states, the prosecution and conviction of individual players is very difficult because they're gambling from home. It is also illegal for a gambling web site to operate within the united states, which is why the offices and servers of most online casinos are located in other countries. There are about 70 countries that allow online gambling sites to set up shop, including australia, new zealand, south korea, denmark, finland, france, germany, and some provinces of canada.
When you register for an online casino, you are required to agree to the site's terms and conditions. Finding out whether or not gambling is legal where you live is your responsibility. You must also abide by any age limits set on gambling in your locality. If online gambling is illegal in your area, and authorities discover that you've won money, your winnings could be forfeit.
Issues of jurisdiction and sovereignty make gambling laws even murkier. The U.S. Wire wager act makes it illegal to use an electronic wire method (which courts generally agree includes the internet) to transmit bets to places where gambling is not allowed. So a casino set up in the netherlands is breaking U.S. Law if a player in the U.S. Plays their games. However, the U.S. Doesn't really have the legal authority to prosecute someone in another country. Since players are almost never prosecuted either, we're left with an illegal act that generally goes unpunished. Of course, if an off-shore casino decides to cheat a player out of winnings, and online gambling is illegal in that player's locality, the player will have a difficult time suing the casino.
This brings us to the topic of regulation. Some of the countries that allow online casinos to operate have strict guidelines and regulations that make sure the casinos operate legitimately. They make sure the casino pays out when players win, and they ensure that published odds match the actual odds programmed into each game. Australian and finnish online casinos are known for adhering to national standards. Some countries are not so strict about regulation and may be more interested in taxing the casinos than making sure that they play fair. There are many online casinos to choose from, and it pays to do some research into the regulations they must follow when you select one.

The case of thompson v. Handa-lopez, inc. Revolved around a california-based online casino that refused to pay out the plaintiff's winnings. The casino operated legally in california because players earned game tokens called "funbucks," which could be redeemed for prizes. This case is notable for two things: it is an oft-cited legal precedent for deciding the jurisdiction when a company operates a web site in one place that is accessed by users in other places; and it shows that not all online casinos are reputable. How to gamble legally in the UK
You'll be happy to learn that in order to gamble legally in the UK, there are only a few requirements you need to meet. These are:
✅ be playing from the UK and have a UK registered address
✅ be able to verify your identity
Below, you can find out more about each of these requirements.
Online casino players in the UK
As a UK resident, you can gamble both online and offline safely and legally, provided you meet all the other requirements. This means that, in addition to bricks and mortar casino venues, you have a wealth of online casino sites to choose from.
Although playing online may seem, to the uninitiated, a little bit more underhand than playing at a land-based casino, the legal rules are exactly the same. However, as there are no physical reassurances that you're stood right there, in a legal jurisdiction, players will have to be able to prove they are actually situated in the UK.
To do this, the online casino will ask you to provide your UK address when registering. They'll also check your IP address, to make sure you are accessing the site from within the UK.
If you do try to circumvent these requirements (e.G by using a fake address or an internet VPN), the casino reserves the right to block your account and withhold your money. In short, it's really not worth it.
Legal age for gambling in the UK
The legal age for almost all gambling in the UK is 18. This age restriction applies to both online and offline sports betting, horse racing betting, casino games, video slots, bingo games.
You are required, therefore, to be eighteen years old or older to use online casinos.
The exceptions to this rule are the national lottery, other lotteries and football pools. You are allowed to participate in these activities from 16 years of age.
Verifying your identity
When you register at an online casino, the casino will automatically perform an identity check using the electoral register. This is to make sure the details you have entered are correct and true.
If for any reason, however, your identity cannot be verified in this manner, the casino will request an official form of identification.
Acceptable ID sources include driving licenses and passports. You may also need to supply the casino with proof of address, which can be supplied in the form of a utility bill.
The reason why the casino must do this is in order to adhere to the UK's ‘know your customer' policy. This policy is in place to ensure that online casinos cannot be used for money-laundering or other illegal activities. Furthermore, it also serves to ensure that you meet the two legal restrictions mentioned above.
Playing at legal online casinos in the UK
If you meet all the requirements we've listed above then gambling in the UK is perfectly legal for you, both online and offline.
UK online casinos themselves are subject to other legal requirements. This means that if you want to rest assured that you're playing at a legal and regulated UK casino, there are a few more things you should consider.
Is the online casino licensed?
First and foremost, any UK online casino must be licensed by the united kingdom gambling commission to be operating legally. According to the gambling act of 2005, the purpose of the licensing system is to:
- Prevent any connection between gambling and criminal activity
- Ensure games are fair, regulated and transparent
- Protect children and vulnerable people from being exploited
As such, a legal UK online casino must meet several checks, including proof of a clear criminal background, proof that the company has sufficient finances to operate, and proof that they have the ability to offer assistance to players, who may develop a gambling problem.
How to find licensed UK online casinos
Given the fact that a licensed casino has to adhere to so many rules and regulations, you can rest assured that these sites are fair and safe to play at. This means that when searching for a UK online casino, you should always check to make sure they do have a UKGC license.
At most licensed UK casinos, the casino will display it's credentials in the footer of the page. Therefore, players can simply scroll down to see a stamp, a crest or a UKGC logo. Moreover, the license number should be clearly displayed in the footer too. Here is an example of the text you can expect to see:
‘casino X is licensed and regulated by the gambling commission (number xxxxxxx) for customers in great britain.'
If you're ever in doubt of the validity of a casino license, you can also check the gambling commission's register. At the UKGC website, you can simply type in the casino's name or license number into their search engine to find the relevant information.
Why are some online casinos licensed outside of the UK?
Throughout the world there are many different regulatory bodies and gambling commissions which license casinos. As such, an online casino may display a non-UKGC license.
It is worth noting, however, that not all casino licenses have been created equally. The UKGC license is by far the most stringent and secure license a casino can offer and therefore it is deemed to be far more trustworthy than licenses from other jurisdictions, i.E curacao.
UKGC licenses are only granted to UK casinos. However, there are some exceptions which allow for casino brands from other countries to operate legally in the UK. These are known as ‘remote operators', and they may come from:
- EEA countries
- Alderney
- Antigue and barbuda
- Gibralatar
- Isle of man
- Tasmania
Any casino which is operative from the remote locations mentioned above will still have to adhere to the UKGC's rules in order to operate within the UK.
What's more, the gambling act 2014 states that any operator from such territories must base an element of their business in great britain, and therefore they will also need a united kingdom gambling commission license.
Are online casinos legal or illegal in the US?
First and foremost, people can legally gamble in online casinos in the USA. Laws governing gambling are always changing on various states but what you should have in mind is that gamblers will not be held liable for making online bets.
The legal gambling states in the US
something that many people in the united states want to know is whether online gambling activities are legal in their jurisdictions or whether it is illegal. On the contrary, the misinterpretation comes from a poor understanding of some laws such as the act of unlawful internet gambling enforcement 2006.
This act has some provisions that have to deal with the wire transfers, with the components stating that no one or company should knowingly receive funds from an individual participating in any illegal online gambling. However, this doesn’t mean a person can’t send their money since the main word is that recipients should not accept the funds.
There are certain laws made pertaining to online gambling and one of them is an additional part of legislation to the SAFE port act. This act was a very important piece of legislation and this is because it passed the senate and the house of representatives.
This is the reason as to why payment processing companies are used as channels for money transfers from online betting sites and casinos. Many online casino operators like casinosecret japan live and operate outside the united states due to the laws in this area.
Such a law creates the need for payment processing companies since a player can’t simply put their credit card information on any online casino they choose. This is something that is always misinterpreted by so many people. They tend to understand the law as gambling is illegal for players and it is illegal for players to transfer any funds to casinos that operate outside the united states.
An important thing to do, is if a player doesn’t feel comfortable with playing online casino games and they are not is a state that has legalized gambling they should research their municipal or county rules in order to check if there is any probation against such activities.Online gambling laws vary in different states in the US with some of them declaring such activities illegal and others have legalized it.
Some other states are still in the process of legalizing online gambling activities. However, it is not every gambling activity that is completely legal, even since there are some states that have more regulated industries. For example, in new jersey, the only legal gambling activity is poker while in new jersey they only offer poker rooms and various casino games since the state has licensed online casinos.
Sports betting is also part of gambling and it had been illegal under federal law. However, sports betting was legalized in may 2018, after the united states supreme court had the ban lifted.
Online gambling in the US
many US citizens still wonder whether online casinos are legal in the US and this is because the united states is a collaged work of federal, state and many local gambling laws. Whether online casinos are legal or illegal depends on where you live and at the moment, some states such as pennsylvania, new jersey and new hampshire have some concerns about the legality of online casinos, lottery sites and poker rooms.
States with legal online casinos
as mentioned earlier, the legality of online gambling depends on the area where you live and states like nevada, new jersey and delaware already offer legal USA online gambling. Players won’t be prosecuted for placing bets at an offshore online casino and you can’t run an online casino in the united states.
Jpmorgan chase believes that by 2025 as many as 20 US states will allow legal online gambling. The US has very strict laws but the ones related to gambling might be legalized soon meaning more players will be able to access legal online casinos in their countries. For each state and jurisdiction in the US, there are different requirements but most casinos have a minimum age requirement of 18 and above.
Registration and playing on online casinos
players have the option of registering on one online casino but they can as well register on multiple casinos and betting sites. Since players are always looking for bonuses and prizes, that’s why they register on dozens of online casinos.
It is possible to play casino games for free in the US as long as you create an account, download the casino’s software, and start playing instantly. Playing at online casinos that are legal you should be assured that the games are safe and fair. It is very important that players find a safe and fair online casino.
Here are some of the top best casinos in the US:
• bovada-it has a great offering of table games, sports betting, live dealers, poker and roulette. With a wide range of payment methods.
• café casino-it features a great welcome bonus and other bonuses to loyal customers. The casino games are available in instant play mode.
• betonline-this casino offers online slots, esports, live betting, poker and a welcome bonus of $1000
• planet7-the casino has a plethora of games, fast payouts using the most popular methods including bitcoin, free spins, progressive bonuses, VIP promos, and great customer service.
• slots. Iv-this is a casino that offers players a choice between $1,000, a 200% welcome bonus and a 300% bitcoin bonus. They also offer slots tournaments, live dealer games and table games.
The choice of whether you would like to gamble online is up to you. It is highly advisable that you avoid it in a state where online gambling is illegal and it is a felony. Despite the fact that the number of US citizens who have been prosecuted is zero you should keep off from illegal online casinos.
Since many states have gambling regulations and laws on their books the prohibition of online casino games can turn into a serious felony.
10 countries where gambling is completely illegal
The two biggest points about gambling when it comes to legislation are that it is a hugely profitable industry, and that the risks posed by problem gambling behaviour are real. Governmental regulators are therefore constantly trying to find a balance between reaping the benefits of a good source of tax, and protecting the citizens who are gambling. These 10 countries have outlawed gambling in one way or another, and those who break the laws may face stiff penalties in some cases.
United arab emirates
Almost all islamic countries prohibit gambling of every kind, but many turn a blind eye to online gambling or simply do not have regulations in place for this grey area. In the united arab emirates, however, any kind of gambling is prosecuted and players can serve up to two years in jail under the penal code’s article 414. The telecommunications regulatory authority controls all internet content and thus prevents access to online casinos.
Brunei
Another islamic country with strict anti-gambling laws, brunei enforces its common gaming house act strongly. This strictly prohibits any form of gambling in the country.
Cambodia
Gambling addiction has historically been an issue for cambodia, and is now banned among its citizens in all formats. Government-sponsored gaming including 5 separately run private lotteries is permitted. The 1996 suppression of gambling act that enforces this does not, however, apply to any foreigners in the country. Several casinos cater to tourists and generate significant revenue.
North korea
Like cambodia, north korea strictly forbids online and offline gambling amongst its own citizens but allows tourists to participate in these activities if they are on guided tours. There is currently only one casino in the country, located in pyongyang.
Japan
All forms of gambling were prohibited in japan until quite recently, although there were several loopholes that meant certain activities did take place. Pachinko, for example, was not classified as a crime because of cultural and historical significance.
Several racetracks are overseen either by the government or the japan racing association, and there are many legal off-track betting facilities for punters who can’t get to the racing grounds. Other sports betting activities are also permitted, and the integrated resort programme law of 2016 has allowed for land-based casino games for the first time.
Online gambling remains strictly illegal in japan, but casinos can now open in resorts as long as the facilities include entertainment venues, an international conference hall and a hotel. Operators themselves are subject to very strict screening, and the entire process of legalising land-based casino gambling in japan is expected to be completed during 2018’s diet session.
Singapore
The private lotteries act prohibits private events unless permission is granted, while public lotteries are regulated by the common gaming houses act. This act prohibits all public lotteries, bingo, terminal-based gaming and other machine-based games unless special exemptions are granted, curtailing public lotteries and all games very effectively. Land-based sports betting in singapore is illegal, but the betting act grants exceptions to the main gambling operators (singapore pools, singapore totalisator board and singapore turf club).
The system of controlling gambling by prohibiting it except in special circumstances extends to public casinos, of which there are only two. Japan’s new gaming model has taken a lot of its cues from singapore, with high minimum betting requirements aimed at limiting the amount that people usually spend on gambling. These generate considerable revenue and are regulated under the casino control act.
Under singapore’s remote gambling act, all forms of online gambling are illegal unless exemption is granted. Singapore turf club and singapore pools were granted exemption in 2016, meaning remote sportsbetting can be conducted through them.
Cyprus
The 2012 betting law governs most cypriot gambling. Slot and other terminal-based gaming is permitted, up to a maximum of 50 machines, but under 2015’s casino law land-based table games are allowed at the single casino, the melco cyprus resort, whose completion is expected in 2019. Sportsbetting is the only form of gambling allowed online.
Qatar
Qatar is the strictest country of all when it comes to gambling laws. All forms of gambling activities are considered illegal, and even sports betting is not permissible. Unfortunately this blanket ban has led to a thriving underground gambling scene, but many pay the price for being involved. Although online gambling is also deemed illegal there are still some who opt to do so, as access to foreign-based sites, although somewhat restricted by the government, is still possible.
Lebanon
In lebanon the law states that gambling of any kind that is unauthorised is illegal, and the government has the power to block online casinos too. Online gambling is only allowed at a designated online casino, and land based gambling is facilitated at casino du liban in jounieh. Additionally, a casino ship often takes players into international waters where they can gamble freely without the worry of breaking local laws.
Poland
Like several other european union member states land-based and online gambling have historically been legal in poland but controlled by strict government monopoly and gambling with offshore operators technically permitted but unregulated. The 2009 act on gambling has seen several amendments to bring it into line with european union principles.
New regulations for online gambling were enacted on 1 april 2017, requiring international operators to apply for sports betting licences. All other online gambling and casino games are legally provided by the country’s designated gambling monopoly only.
These 8 countries all have strict anti-gambling policies in place and it advisable that locals and visitors do not challenge them in any way.

The legality of online gambling
Gambling online falls into a legal grey area. While it is technically illegal in most of the united states, the prosecution and conviction of individual players is very difficult because they're gambling from home. Legal online casinos & online gambling
Online casinos are legal in most parts of the world. Many world governments have written laws specifically addressing the legalities of online gambling; others like the united states depend heavily on state law and an existing legal vacuum to keep online gambling in check. The legality of an online casino has something to do with that casino’s proper operations and something to do with the legality of online gambling where you live. Finding legal online casinos isn’t hard, you just have to know what you’re looking for and shop around a little.
Comparing legal online casinos is a matter of first finding out if casino gambling online is legal where you live, then doing a little bit of work browsing online casino sites and comparing their features.

How to find legal online casinos
If you’re shopping around for a legal online casino, a place to play online slots or casino table games, there are a few things to consider. Your first concern should be finding a legitimate casino that operates legally and pays out winnings fairly. Once you’ve found a few legal online casinos, other factors become important. Here are two questions that should help you find a good legal online casino.
Does this casino have a good reputation?
You don’t have to ask yourself this question with some of the bigger names in the online gaming industry. A big casino gambling site like bet365 or betsson that has been accepting wagers since long before they launched a website, is obviously a legitimate business, sometimes even a household name.
If an online casino is operated by a publicly-traded company, displays valid gaming licenses prominently on their website, and does not bring up a ton of red flags when you google the name, it is probably a site with a good reputation.
Not all casino sites have the same experience in the casino business, and you’ll need to test their reputation on your own. Again, browsing around the website and reading online reviews should tell you enough to know if the site is legit or not. You want to see gaming licenses and auditing certificates posted prominently on the site along with an active customer service department. Online casino gambling forums are also good sources for information about fraudulent or illegal online casinos.
Does this casino accept wagers from citizens of my country?
Remember that online gaming laws vary from country to country and region to region. The result is that not every online casino is able to do business with people from all over the planet. Depending on the gambling laws in the country where you live, you may find a number of sites that simply don’t offer gambling to people from your country.
The best example of this comes to us from north america; people living in the USA and canada have had the doors of many online casinos shut in their faces, thanks to tighter regulation of online gambling and rumors of future legislation against online casinos operating in the US or canada. To find out if players from your country are restricted, check the site’s FAQ page or contact customer service.
Are all online casinos legal?
Unfortunately, there’s no easy answer to this question. Federal and local laws exist all over the world that restrict online casino gambling, while other governments explicitly state that online casino gambling is legal; some even tax and regulate online casino play to raise revenue. The worldwide legal status of online gambling is too much to take all at once, so concentrate instead on gambling laws where you live.
To figure out if there are laws against online gambling in your country, state, or region, you’ll need to spend a little time researching. It doesn’t matter where you get information about the legality of gambling online, just that the information is accurate. A few websites have popped up directly addressing the legality of online gambling in different parts of the world, and the best of these provide sources for their information.
Sometimes you’ll luck out and find out about the legal status of gambling where you live through a gambling website. Try to access an online casino site from a restricted country and you’re likely to see a pop-up explaining that citizens of your country aren’t allowed to gamble for real money at that particular site. Restricted access to online casinos is not always due to laws against online gambling; american gamblers are shut out of many online casinos because the casino chose to avoid future legal problems, fearing new laws in america to make online gambling illegal. It’s confusing, but any industry that does business with hundreds of different countries and legal traditions is bound to be confusing. If you live in the united states, you might be interested in our laws section, which reviews the current legal status of gambling within each state. This includes colorado, hawaii, new jersey, delaware, nebraska, and new hampshire – among others.
If all else fails and you’re still not sure if online casino gambling is legal in your area, your best bet is to consult a legal professional. If you can’t figure out from other sources if there are laws against playing at online casino sites, it’s best to avoid potential legal troubles by talking to a lawyer.
A final tip when hunting down legal online casinos: contact a casino’s customer service department and ask them all your legal questions. Online casinos make customer service available for a reason: they want to answer your questions about the casino’s website site, help you with banking or gameplay problems, and assist potential customers in figuring out if their casino is a good fit. Any decent online casino site will post contact information clearly, usually under a tab like “contact us.”
If the online casino you’re researching has a live chat program, where you use something similar to an instant messenger service to talk to customer support staff, you’re in luck. Talking to customer service about the legality of the site for people in your country using live chat is the fastest and easiest way to get an answer to your question. Talking to a casino site’s customer service team gives you the chance to find out if your country is restricted and to ask any other questions you have. Use this opportunity to test the services offered, including how long you have to wait for an answer and the amount of knowledge the support staff has. A good customer service staff at your online casino is invaluable.
Is it legal to gamble online in the USA?
The state of the states
One topic of interest to the millions of individual united states citizens out there is whether or not online gambling is legal in their respective states. For example, roulette players may wonder - is online roulette legal? Online gambling is treated differently throughout the country with several states having declared it completely illegal, some have actually legalized it, and others have legislation in the works. Not all types of online gambling are fully legal even in states that do have more or less regulated industries.
The first myth that should immediately be dispelled is that online gambling (by the gambler himself/herself) is in any way prohibited by federal law. That myth is absolutely untrue and stems from a poor understanding of the unlawful internet gambling enforcement act of 2006. One of the provisions of this act has to do with wire transfers, and it essentially states that no person or entity may knowingly accept any funds associated with a person participating in illegal online gambling. The key component of the wording is that they may not, "accept," your money, it has no bearing on your ability to send the money.
Furthermore, the fact that this law can even exist is patently ridiculous because it was nothing more than an add-on piece of legislation to the SAFE port act the SAFE port act was a necessary piece of legislation for various reasons, and it passed the senate unanimously and passed the house of representatives almost unanimously (two nays). Unfortunately, this act was tacked on by a group of republicans who, I am guessing, do not identify as libertarian. While the SAFE port act was essential, the UIGEA was not, but many legislators complained that they did not even have the opportunity to read it. With that said, it is highly unlikely that, if they had, the SAFE port act would have failed.
It is for this reason that payment processing companies are often used to facilitate money transfers from the players to online gambling sites. Many of these operators (and virtually all of the key players for the gambling sites) live and operate outside of the U.S. Due to this law. Furthermore, it also creates a need for the payment processing companies themselves as opposed to a player being able to simply put his credit card information in on any online gambling website the player chooses and transferring funds.
This language is often misinterpreted as making it illegal for players to knowingly transfer funds to online casinos located outside of the united states, to use their own credit cards in order to do so or to knowingly send money through a payment processor for the purpose of gambling online. At the federal level, none of these statements could possibly be less true. The UIGEA has no provisions in it whatsoever that would call for the penalization of individual players who choose to gamble online or transfer funds for this reason.
The first thing that one should do, if one feels uncomfortable with online gambling and is not in a state in which it is expressly legal, is to research your municipal or county rules and see if there is a prohibition against it. Beyond that, you might try to determine whether or not anyone in your state has faced charges for gambling online. It might technically be illegal, but essentially unenforced. Many of these laws were also written prior to the existence of the internet and have not been updated, likely because the lawmakers do not consider this a high priority, and also, many of the laws are puritanical in nature.
With that said, however, there are many states that have laws and provisions that either allow or disallow online gambling, so let's take a look at some of those:
In nevada, only poker is available for legal consumption; new jersey offers poker rooms and other types of casino games at its state-licensed online casinos. As for sports betting - a form of gambling that was illegal under federal law - it has received a chance to be legalized in may 2018, when the US supreme court lifted the ban and allowed each individual state to decide whether or not legislation will take place.

Online casino regulation and legality
Online casino gambling made its debut in the early 1990s, and the industry has been booming ever since. The current legal online gambling climate differs from country to country. In the united states, it can even differ from state to state while in countries outside of the US, legal online casino gambling is prevalent and welcomed.
In the US, only a handful of states have actually authorized state-regulated online casino gambling, including nevada, delaware, and new jersey, who were the first to do so. There are also several other states which have adopted friendly and legal state-based online gambling legislation for their residents and visitors. Additional states are in the process of creating or passing legislation to allow them to enter the domestic online casino market in the united states.
There are still restrictions that come into play, but by and large, united states citizens without access to state-sponsored US internet casinos can still legally enjoy the web's version of the physical las vegas experience by playing at legitimate and legally licensed offshore casinos. There are no federal laws prohibiting offshore online casino gaming.
Online casino betting legality is, however, a frequently changing picture as we've seen through the state-licensed online gambling platforms that are emerging. The FAQ section below will address a host of elements concerning the online casino gambling industry as it pertains to USA players to ensure that american residents have all the information they need to make informed decisions regarding their involvement in real money casino gambling on the internet.
Frequently asked questions about legal USA online casinos
The following information addresses the most commonly asked questions concerning legal online casino gambling in the U.S. We attempted to answer them all with thoughtful, in-depth answers to leave no room for misunderstanding the concepts associated with the online gambling industry and your options as a USA player.
Are online casinos legal in the united states?
In a nutshell, there is nothing at all illegal about playing at an online casino if you live in the united states. Prohibitions in US federal laws have historically targeted those seeking to operate an online casino within the united states, and until 2011 when the DOJ re-interpreted the reach of the federal wire act, nobody was allowed to do so. It has never been illegal to access or play real money games at an offshore online casino that is operating legally within its residing jurisdiction and the industry as a whole.
There are two states that do prohibit online gambling in general, regardless of its source, those being connecticut and washington. Though the restrictions are not enforced in these two states, we suggest players in those states follow the rule of law.
As mentioned above, there are multiple US states that have launched a state-licensed and regulated online casino gambling platform for their residents. Players who are located within those states have access to state-sanctioned online gambling. Anybody located outside of those regions must either rely on land-based gambling destinations or consider visiting legally licensed and regulated offshore casino websites.
What laws pertain to online casino gambling in america?
The federal wire act was relevant to state-regulated online casino gambling prior to 2011 when the DOJ deemed the law to only apply to US-based sports betting. However, since the repeal of PASPA in 2018, the primary function of this law is to restrict interstate wagering, or in other words, prohibit bets from crossing state lines. This has caused some conflict with states that have entered into interstate gaming compacts to share player pools - so those details are still being hammered out.
The UIGEA law does not prohibit US residents from participating in gambling at legitimate online casinos that are regulated and located outside of america. In fact, the unlawful internet gambling enforcement act is not directed at players at all but rather targets online casino operators and payment processors, administering regulatory oversight regarding how online gambling transactions can be processed.
There are no federal laws that make it illegal for U.S. Residents to participate in offshore online casino gambling at destinations that are operating within the industry legitimately, meaning they are legally licensed and regulated by a respected governing jurisdiction or they are owned and operated by a parent company that holds licensing credentials for one or more jurisdictions. Therefore you are not violating any US laws by enjoying real money casino gambling on the web as long as you are restricting your gameplay to legitimate websites.
What is the legal online gambling age in the US?
This is one instance where state law takes the driver's spot. Most american friendly online casinos accept players as young as 18 years old. However, most states mandate that players meet a minimum age requirement of 21 years old before they can legally engage in gambling entertainment. The laws in your state will dictate the legal age at which you may access legal online casino destinations.
Players who live in a state without an established gambling age cannot gamble online at a reputable online casino prior to turning 18. Anyone participating in underage gambling is subject to criminal prosecution by state or local law enforcement. The legal gambling age in the united states varies by state.
Are online casinos located offshore safe?
As long as you restrict your involvement to only those casino websites that have been verified to be legally licensed and regulated by a legitimate governing jurisdiction, then yes, enjoying online casino games online is perfectly safe. If you waiver on legitimacy even slightly, you risk landing at a dangerous, questionable or low quality casino destination. The sites we recommend are audited for fair gaming practices by third party agencies.
Each of the casinos you see recommended in this guide have been vetted by our team of professional analysts to ensure they hold legitimate licensing (or are owned and operated by a parent company that does) and are subject to genuine regulatory oversight from a respected governing authority.
We also closely examine their security protocols and technology to ensure that any brand included in our guide is able to adequately protect your sensitive data. In order to be considered for inclusion here, each casino must employ a security profile that exceeds licensing requirements and industry standards to provide protection that is comparable to world-class financial institutions.
What types of games will I find at US friendly online casinos?
The online casinos recommended in this guide all provide a substantial selection of casino games in their menu. Flash technology, cutting-edge 3-D graphics, video, and animation mean very realistic vegas style versions of popular casino games like slots, baccarat, blackjack, roulette, video poker, let it ride, keno, and craps. You will find that some of these casinos also offer additional platforms, such as sports betting, horse racing, esports and poker.
Am I required to download software in order to play real money casino games online?
Most reputable online casinos offer an option for instant play casino games or a downloadable suite of casino games. In some cases the downloadable option provides an expanded selection of games and features, however, I personally use the instant play casino games option more often than not, and I've never been disappointed with the performance or selection. Downloadable games are becoming fewer and far between as technology advances.
All of our recommended gambling destinations also offer a mobile casino app to play their games from your smartphone or tablet, and 99% of the casinos do not require a download of any kind in order to access and enjoy the games.
How do I make deposits and withdrawals
Most US friendly internet casinos support cryptocurrency deposits such as bitcoin, credit card deposits and check or money transfer withdrawal options. You will also occasionally see additional US friendly deposit and withdrawal options such as secure payment vouchers, and prepaid cards.
The selection of funding methods varies from brand to brand. You can log into a casino's banking suite for more information, or speak to customer support for assistance. We recommend everyone become familiar with bitcoin and signup with one of the recommended legal bitcoin casinos we review. Bitcoin is the future of online gambling, online shopping, and money transfers, so it will benefit you in more ways than one to learn about it.
What are the most important considerations that every player should pay attention to when selecting an online casino to play at?
Here are our number one requirements that determine if a brand is worthy of further scrutiny for possible inclusion in our guide. Our process is of course much more in-depth, but these elements will immediately rule out the questionable brands:
Legality – does the casino (or its parent company) hold legal licensing and are they regulated by legitimate governing authority? This is the first thing we look at. A casino that can't meet this requirement is definitely off our list. Most reputable brands are fairly transparent with this information and proud to share documentation that validates their compliance with industry regulations.
Security – we have very stringent standards when it comes to the security profile of any online gambling site. We require the presence of advanced data encryption technology, sophisticated fraud prevention and antivirus protection, and a trained professional technical team for monitoring these systems around the clock.
Reputation – we reach out to other industry professionals and players to see what a casino's reputation is like throughout the online gambling community. While we don't make any decisions based solely on this information, we do take it into consideration and compare it to our own experiences when testing and examining the site ourselves.
Performance – we require a high end, a feature-rich performance that is free of glitches and software triggered interruptions. Because consistency is a key indicator, our testing period is significant in order to return legitimate results.
Customer support – incompetent or non-responsive customer support is a deal-breaker for us. We aggressively test their competence, responsiveness, and ability to deal with issues from simple to complex. Anywhere that you consider investing your money has got to provide a high-quality customer support staff or your money will always be at risk.
Banking suite – we must find successful support of US friendly deposit methods and withdrawal options. After all, if you can't get your money in and out of the casino, what good are they? They must also process transactions timely and efficiently.
If a particular online casino scores high on all these elements, we take them to a deeper level of testing and put them on the potential list for inclusion in our guide.
Are online casino bonuses legit?
The answer to this question depends on where you are playing. If you are visiting one of our recommended casinos, then yes, the bonus offers and promotions are legitimate and are accompanied by reasonable wagering requirements and terms. Most of these offers are structured as match deposit bonuses in which casino site agrees to match a certain percentage of your initial deposit or group of deposits. For example, if a casino offers a 100% match up to $100, they are saying they will match your initial deposit up to a maximum of $100.
On the flip side, the questionable online casinos use attractive bonus offers to lure in unsuspecting players with no intention of honoring the agreement. This is another danger that can be alleviated by relying on expert input regarding which online casino brands you should consider playing at.
Is internet gambling legal in the USA?
Over the last few weeks we have been covering several court cases that have the potential to change the face of internet gambling in the U.S. Forever.
Last month imega, an online gambling advocacy group based out of washington DC, sued several government agencies in an attempt to overturn the unlawful internet gambling enforcement act (UIGEA), which was passed in 2006.
The UIGEA is a federal law that was passed in an attempt to forbid internet gambling in the U.S. However, the law does not TECHNICALLY make internet gambling illegal, it only makes it illegal for financial institutions to accept any money that is part of an “illegal internet gambling” transaction.
That being said, there is actually no federal law on the books that defines what “illegal internet gambling” is.
Since there is no federal law defining illegal online gambling, imega attemted to have the law overturned on the grounds that it is too vague and that it violates citizens’ right to privacy.
Earlier this week, the court came back with the decision that the law is indeed clear.
As was stated in the official ruling passed down the three judge panel, “it bears repeating that the act (UIGEA) itself does not make any gambling activity illegal. Whether the transaction…constitutes unlawful internet gambling turns on how the law of the state from which the bettor initiates the bet would treat that bet, i.E. If it is illegal under that state’s law, it constitutes “unlawful internet gambling” under the act.”
In other words, the UIGEA makes placing a wager online illegal, but ONLY if the law of the state in which the bet is being made says that online gambling is illegal. For example, if I live in the state of california (where there is no law against internet gambling), then according to this recent court ruling, the UIGEA does not apply to me.
Since there are only 6 states that expressly forbid internet gambling, there are 44 states where it is not considered illegal.
So does this mean that internet gambling is now legal in those 44 states?
Gambling is not technically illegal in those 44 states, but the financial institutions will not be opening their doors for online gambling bets just yet. Because it would be a little sticky for the banks to start accepting gambling money from some states and not others, there will likely need to be at least a few more days in court before you can wire your bookie your NFL bets through your wells fargo account.
